Back Rent index reform - More requirements for rent increases

On July 1, 2022, the law to reform the rent index law will come into force. As a result, cities with more than 50.000 inhabitants will be subject to a rent index as of January 01, 2023. For cities with more than 100.000 inhabitants, qualified rent indexes, i.e. rent indexes prepared according to scientific knowledge, are provided. In tense regions, there will also be a reduction in the cap on rent increases. The rental price brake has also been extended until 2029.

Local comparative rents are determined on the basis of the rent index. These are the primary orientation for rent increase requests for current tenancies as well as for new leases concluded within the scope of the rental price brake. Both sides, tenants and landlords, depend on meaningful rental games.

The law is intended to take into account the goal of increasing the quality and dissemination of rent indexes as well as legal certainty for tenants and landlords.
